CERIL Statement and Report on Cross-Border Effects in European Preventive Restructuring

The Conference on European Restructuring and Insolvency Law (CERIL), a nonprofit dedicated to the improvement of European insolvency laws, has released the CERIL Statement and Report 2022-2, the latest publication on Cross-Border Effects in European Preventive Restructuring.

The Statement and Report, prepared by Reporters Stephan Madaus of Martin Luther University and Bob Wessels of University of Leiden, identify and assess the benefits and shortcomings of selecting the European Insolvency Regulation 2015 to govern proceedings in preventive restructuring frameworks. Wessels also served as Co-Reporter for Transnational Insolvency: Global Principles for Cooperation in International Insolvency Cases, an ALI Report published in 2012.
