David McGowan is the Lyle L. Jones Professor of Competition and Innovation Law and Director of the Center for Intellectual Property Law & Markets at the University of San Diego School of Law. He teaches and writes in the areas of intellectual property, antitrust, and legal ethics.

Professor MGowan’s research addresses topics such as antitrust policy in software markets, the implications of network effects for IP policy, legal problems associated with standard-setting organizations, open-source software development, and the elements of judgment students must acquire to develop judgment about practicing law.

He began his legal career clerking for Judge A. Raymond Randolph of the U.S. Court of Appeals for the District of Columbia Circuit and later practiced in the San Francisco offices of Skadden Arps Slate Meagher & Flom and later Howard Rice Nemerovski Canady Falk & Rabkin.

Professor McGowan taught at the University of Minnesota School of Law from 1998 until he joined the USD School of Law faculty in 2005.
